These Terms and Conditions ("Terms") govern your access to and use of the Patreek website ("Website"), the related services offered by Sentigraph Inc. ("we," "us," or "our"), and the content available through the Website (collectively, the "Service").
1. Acceptance of Terms
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service.
2. Age Requirement
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and of legal capacity to enter into a binding agreement.
3. User Accounts
You may need to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activity that occurs under your account.
4. Content
The Service contains content owned or licensed by us and our licensors ("Content"). The Content is protected by copyright, trademark, and other intellectual property laws. You agree not to copy, modify, distribute, sell, or create derivative works of the Content without our express written permission.
5. User Generated Content
You may be able to submit content to the Service, such as comments or reviews ("User Generated Content"). You retain all ownership rights to your User Generated Content. However, by submitting User Generated Content, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, publish, and translate your User Generated Content in connection with the Service. You also represent and warrant that your User Generated Content does not violate any third-party rights.
5A. Content Rating, Audience & Community Standards
Patreek is designed for a general audience (13+) and is intended for informational, educational, and community discussion purposes. All content on Patreek—including advertisements, posts, comments, curated summaries, and user submissions—must remain appropriate for a broad audience. Content that is sexually explicit, pornographic, overly violent, profane, hateful, harassing, or otherwise X-rated is strictly prohibited. We do not allow content that promotes hate speech, racism, discrimination, or demeaning language toward any protected group. We reserve the right to remove content, suspend accounts, or permanently ban users and advertisers who violate these standards. By participating in the Patreek community, you agree to maintain respectful, fair, and civil interactions at all times.
6. Third-Party Services
The Service may contain links to third-party websites or services. We are not responsible for the content or practices of any third-party websites or services. Your use of third-party websites or services is subject to the terms and conditions of those websites or services.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
9. Termination
We may terminate your access to the Service for any reason or no reason, at any time, without notice.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms will be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in Melissa, Texas, United States of America.
12. Entire Agreement
These Terms constitute the entire agreement between you and us regarding your use of the Service.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
14. Updates to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the Website. You are advised to review these Terms periodically for any changes. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the revised Terms.

16. Digital Utility Tokens ("Poins")
- Poins are a virtual, non-transferable, and non-refundable digital utility token designed solely for use within the Patreek.com ecosystem. Poins are not money, currency, legal tender, or any form of investment contract or security under any jurisdiction.
- Poins have no real-world monetary value and cannot be exchanged, sold, or redeemed for any fiat currency, digital asset, or anything of value outside of the Services. Poins are “Dead End” tokens intended for consumption only.
- Poins are licensed, not owned. The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use Poins for specific in-app functionalities, such as boosting user-generated content, purchasing internal advertising placements, and tipping other users for social recognition.
- All purchases of Poins are final and strictly non-refundable. The Company is not obligated to repurchase Poins or provide a refund for unused Poins, even if your account is terminated or the Services are discontinued.
- Prohibited uses: attempting to sell or trade Poins for real money on secondary markets; using Poins to facilitate any form of wagering, betting, or games of chance. Violations may result in immediate account termination and forfeiture of all Poins without compensation.
XP has no monetary value, cannot be purchased, and is used solely to measure community engagement and participation in social events.
17. Ad Revenue Sharing Program (the "Program")
- Nature of the Relationship. Participation in the Program does not create an employment, partnership, or investment relationship between the Member and Patreek. By reaching Level 3+ and maintaining a Gold or Ruby Membership, you act as an independent Content Provider. Payments are strictly a service fee for traffic and engagement your content generates for Patreek’s advertising partners.
- Eligibility and “Active Participation.” To be eligible for Revenue Sharing, a Member must: (a) maintain a valid Gold or Ruby Membership; (b) be at Level 3 (Neonate) or higher; (c) comply with all Community Guidelines (hate speech, spam, or “click-farming” result in immediate disqualification and forfeiture of pending revenue); (d) optionally, participate in at least X community actions or Predictions per month to prove Active Status.
- Revenue Calculation (RPM Model). Revenue is calculated on Net Ad Revenue actually received by Patreek from third-party advertisers. Formula: (Net Monthly Ad Revenue / Total Platform Member Views) × (Your Qualified Member Views) × 0.20. Only Member views count; guest/bot/non-logged-in views are excluded. Ad rates fluctuate; Patreek does not guarantee any specific monthly income or “return on investment.”
- Payouts and Taxes. Payouts occur only once the Member balance exceeds $20.00 USD. Members are responsible for all taxes. Patreek may require a Form W-9 (U.S.) or W-8BEN (non-U.S.) before payout. If a membership is canceled or an account is banned for terms violations before reaching the $20 threshold, all accrued revenue is forfeited.
- Non-Interference with Prediction Markets. Revenue Sharing is funded solely by third-party advertising revenue. No funds from XP-based Prediction Markets, Poin purchases, or other community games are used to fund Revenue Sharing; these systems are legally and operationally separate.
